- "Customer", "You", or "Your" refers to any individual or legal entity that uses the Company’s services.
- "Goods" means any parcels, freight, or items transported or handled by Mercer Couriers on behalf of the Customer.
- "Services" refers to the courier and transport services provided by Mercer Couriers, including but not limited to parcel delivery, bulk freight transportation, and associated handling services.
- "Website" refers to the Company’s online platform located at www.mercercouriers.com.au and any subdomains or related sites.
- "Order" refers to any request or agreement by the Customer for the Company to provide transport or delivery services for Goods.
- "Business Day" means any day other than a Saturday, Sunday, or public holiday in the Northern Territory, Australia.
- "Force Majeure" means any event beyond the reasonable control of the Company, including but not limited to acts of God, war, industrial disputes, and government actions, which affect the Company’s ability to perform its obligations.
- "Recipient" refers to the person or entity to whom the Goods are being delivered.
- "Consignment" refers to the Goods transported by Mercer Couriers on behalf of the Customer, regardless of the number of items.
2. Acceptance of Terms
By using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must cease using our services immediately.
3. Use of the Website
3.1 Access to the Website
Access to the website is provided on an "as-is" and "as-available" basis. Mercer Couriers makes no guarantee that the website will be free from interruptions, errors, or viruses. You are responsible for ensuring that your access to our site is secure and free from any issues.
3.2 Prohibited Conduct
You agree not to:
- Engage in any activity that disrupts or interferes with the website's operation;
- Use the website for any unlawful or fraudulent purpose;
- Attempt to gain unauthorized access to any part of the website.
4. Orders and Delivery
4.1 Order Placement
Customers may place orders for the Company’s services either online via the website or through other communication methods approved by the Company. All orders are subject to acceptance by Mercer Couriers.
4.2 Delivery Times
Mercer Couriers will make reasonable efforts to deliver Goods within the estimated delivery timeframes. However, the Company does not guarantee specific delivery dates or times and is not liable for delays caused by unforeseen circumstances.
4.3 Customer Obligations
Customers must provide accurate and complete delivery information. Any costs or delays arising from incorrect or incomplete information provided by the Customer will be the responsibility of the Customer.
4.4 Failed Deliveries
In the event of a failed delivery attempt due to the absence of the recipient or other reasons beyond Mercer Couriers' control, the Company may charge additional fees for redelivery or storage.
5. Payment Terms
5.1 Pricing
All prices for services are quoted in Australian dollars (AUD) and include any applicable taxes. Prices are subject to change without notice, but any agreed-upon pricing for confirmed orders will be honored.
5.2 Payment Methods
Mercer Couriers accepts payment via credit card, bank transfer, and other payment methods as specified at the time of order placement. Payment must be made prior to delivery unless otherwise agreed in writing.
5.3 Late Payments
If payment is not received by the due date, Mercer Couriers reserves the right to charge interest on overdue amounts at the rate of 1.5% per month. The Company may also suspend or terminate services until full payment is received.
5.4 Refunds
Refunds will only be provided where Mercer Couriers fails to provide the agreed service, and such failure is directly attributable to the Company. Refunds are issued at the Company’s discretion and must be requested in writing within 30 days of the issue.
6. Not a Common Carrier
Mercer Couriers is not a common carrier and reserves the right to refuse to carry any Goods without explanation. The carriage of Goods is subject to these Terms, and Mercer Couriers does not undertake to deliver Goods for all customers or all classes of goods.
7. Exclusion and Limitation of Liability
7.1 No Warranties
Mercer Couriers makes no warranties or guarantees regarding the quality, suitability, or accuracy of the services provided.
7.2 Exclusion of Liability
To the maximum extent permitted by law, Mercer Couriers is not liable for:
- Loss or damage to Goods during transit;
- Delays in delivery;
- Indirect or consequential loss, including loss of profits or business.
7.3 Limitation of Liability
Where the Company’s liability cannot be excluded by law, Mercer Couriers’ liability is limited to the lesser of $100 per consignment or the value of the Goods.
8. Intellectual Property
8.1 Ownership
All content, including but not limited to text, graphics, logos, and software, available on the Mercer Couriers website is the property of Mercer Couriers or its licensors and is protected by intellectual property laws.
8.2 Restrictions on Use
You may not reproduce, distribute, or create derivative works from any content found on the website without prior written consent from Mercer Couriers.
9. Termination
9.1 Termination by the Customer
Customers may terminate their use of the services at any time by providing notice in writing. Termination does not relieve the Customer of any payment obligations for services already rendered.
9.2 Termination by Mercer Couriers
Mercer Couriers reserves the right to terminate or suspend services to any Customer for any reason, including failure to comply with these Terms.
10. Changes to Terms
Mercer Couriers reserves the right to modify these Terms and Conditions at any time. Changes will become effective upon posting on the website. Continued use of the Company’s services after the posting of changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms and Conditions are governed by the laws of the Northern Territory, Australia. Any disputes arising out of or in connection with these Terms or the services provided by Mercer Couriers will be subject to the exclusive jurisdiction of the courts of the Northern Territory.
